These Terms of Service ("Terms") govern your use of the Tornee mobile application ("the app", "we", "our"). By using Tornee, you agree to these Terms.
1. Description of Service
Tornee is a delivery route optimization and navigation app. It allows drivers to add delivery stops, optimize the route order using real-time traffic data, and navigate with turn-by-turn directions. The app works offline with local storage and optionally syncs data to the cloud when signed in.
2. Account
Account creation is optional. You can use Tornee fully without an account. If you create an account, you are responsible for maintaining the security of your login credentials. You must provide a valid email address for account registration.
3. Subscriptions and Payments
Tornee offers a free tier with limited features and a Pro subscription that unlocks all features.
- Subscriptions are billed monthly or annually through the Apple App Store or Google Play Store.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription in your device's App Store or Play Store settings.
- Refunds are handled by Apple or Google according to their respective refund policies.
- A free trial may be offered for new subscribers. If you do not cancel before the trial ends, your subscription will begin and you will be charged.
4. Acceptable Use
You agree not to:
- Use the app for any unlawful purpose
- Attempt to reverse-engineer, decompile, or tamper with the app
- Interfere with the app's infrastructure or other users' access
- Use the app while driving in a manner that distracts from safe operation of a vehicle
5. Your Data
You own your delivery route data. We do not claim ownership of any content you create in the app. When you delete your data or account, your cloud-stored data is permanently removed. Local data is stored on your device and removed when you uninstall the app. For details on how we handle your data, see our Privacy Policy.
6. Intellectual Property
Tornee, including its design, code, and branding, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the app for personal or business delivery purposes.
7. Third-Party Services
Tornee relies on third-party services including:
- Mapbox — for maps, geocoding, route optimization, and navigation
- Firebase — for authentication, cloud storage, analytics, and crash reporting
- RevenueCat — for subscription management
These services have their own terms and privacy policies. We are not responsible for their availability or performance.
8. Disclaimers
Tornee is provided "as is" without warranties of any kind. Specifically:
- Route optimization results are suggestions based on available data. We do not guarantee the shortest, fastest, or most efficient route in all conditions.
- Navigation directions depend on Mapbox data and may not always reflect current road conditions, closures, or restrictions.
- We are not responsible for missed, late, or failed deliveries.
- Always follow local traffic laws and use your own judgment while driving.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability for any claim related to the app shall not exceed the amount you paid for the subscription in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your access to the app if you violate these Terms. You may stop using the app at any time. Upon termination, your right to use the app ceases, but provisions that by their nature should survive (such as limitations of liability) will remain in effect.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the app after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of Belgium. Any disputes shall be resolved in the courts of Belgium.
